1. Scope and Contracting Parties
These Terms and Conditions apply to all paid services provided by voWi Consulting ("voWi") under the Pure Promotion Service to individuals ("Client"). The Pure Promotion Service comprises exclusively services relating to professional visibility, personal branding, and career promotion. These services explicitly do not constitute employment agency activity within the meaning of the Irish Employment Agency Act 1971, the German Sozialgesetzbuch III or other corresponding European legal regulations. voWi does not place candidates in roles, negotiate employment contracts, or maintain any contractual relationship with employers.
2. Formation of Contract and Pre-Contractual Phase
Submitting a contact enquiry via the website or by email does not create any contractual relationship and does not constitute a binding offer. It constitutes a non-binding request inviting voWi to arrange an initial conversation.
Following the initial conversation, voWi may submit an individual proposal setting out the specific services, their scope, duration, and price. This proposal is binding on voWi for the acceptance period stated within it. A binding contract is formed exclusively upon the Client's written acceptance of this individual proposal. By signing the individual proposal or contract, the Client accepts these Terms and Conditions.
3. Service Description
The Pure Promotion Service comprises services relating to professional visibility, personal branding, and career promotion for specialists and senior leaders in the Life Sciences and medical sectors. All services delivered under this service are exclusively promotional, editorial, and communicative in nature.
The specific services, their scope, duration, and delivery timelines are set out exclusively in the individual proposal and the mutually signed service agreement. These Terms and Conditions do not contain any description of individual services; the individual agreement is the sole authoritative document in this regard. The Client has no entitlement to services not agreed upon in the individual contract.
All services under the Pure Promotion Service expressly exclude direct contact by voWi with employers on behalf of the Client for the purpose of job placement, the placement of specific job offers, the negotiation of employment terms, and any guarantee of a specific employment outcome.
4. Pricing and Payment Terms
Prices are set out in the individual proposal and are due before commencement of services unless otherwise agreed. All prices are inclusive of Irish VAT where applicable. In the event of late payment, voWi is entitled to suspend service delivery until the outstanding payment is received.
5. Right of Withdrawal for Consumers
Where you are acting as a consumer under EU consumer law, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days from the date of contract conclusion. To exercise your right of withdrawal, you must inform voWi Consulting, 20 Harcourt Street, Dublin 2, Ireland, email: info@vowiconsulting.com, by means of an unequivocal statement of your decision to withdraw. Where you have expressly requested that service delivery commence before the expiry of the withdrawal period, your right of withdrawal lapses in respect of services already fully performed.
6. Limitation of Liability
voWi provides no warranty, guarantee, or representation of any kind that the services will result in the Client obtaining employment, a job offer, or any other specific professional outcome. voWi warrants solely that the agreed services will be delivered with reasonable skill and care. voWi's total liability is limited to the amount of remuneration paid by the Client in the three months preceding the event giving rise to the claim.
7. Confidentiality and Data Protection
voWi treats all information provided by the Client as confidential. No information is shared with employers or third parties except where strictly necessary for the delivery of the services expressly commissioned. voWi's Privacy Policy, available at [link to privacy policy], applies.
8. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Irish law. Consumers resident in the EU may rely on the mandatory protective provisions of their country of residence notwithstanding this choice of law.
